Dick clark

 Dick Clark’s New Year’s Rockin’ Eve-Ke$ha hits the stage to perform on Dick Clark’s New Year’s Rockin’ Eve with Ryan Seacrest on Friday (December 31) in New York City.

The day before, the 23-year-old pop phenom was spotted leaving her hotel en route to rehearsals.

Ryan co-hosted the annual bash, while Jenny McCarthy served as a special correspondent.

Owen wilson Died at age of 38 years Old-Another hoax, really!? It must be nearing 10 death hoaxes that I have had to write about and let everyone know that someone is not dead. Aretha Franklin, Adam Sandler and a few other folks are still alive and well. The Owen Wilson death is the latest hoax that was sent out.

The Owen Wilson death was reported by a faux news agency called Global Associated News. Come on people, just because a site says that it has news doesn’t mean you can take their word and go tweet it all over the net. This irresponsible act has caused many actors and actresses to have to come out and show themselves so people don’t think they are death. The Owen Wilson death went along the same story line as the Adam Sandler death hoax.

What if someone really does die? Who is going to believe it after all of these hoaxes? Seriously people, you need to stop with the fake news because it’s getting old. The Owen Wilson death “news” was not funny.

Since Christmas Day 2010 is a Holiday, a lot of people are asking the which stores are open on Christmas Day 2010. They want to find out the Holiday store hours of retailers like Walmart as they want to do last minute shopping to buy Christmas gifts and foods this Holiday season.


Usually, we tend to forget other stuffs since we usually enjoy the Holidays with our friends and loved ones as you utter the words: “Oh no, I forgot something. I hope that Walmart or Best Buy is still open!” Well, unfortunately some Walmart stores are now closed already because their operating Christmas store hours for today’s Christmas Eve will be up until 8pm only. Meanwhile, Best Buy closed earlier at 7pm since their Christmas holiday store hours for today’s Christmas Eve was from 7am to 7pm only.

The employees of Walmart and Best Buy need to be with their families to celebrate Christmas come Christmas Eve. For sure, they are more than happy to find out that they do not have to work on Christmas day and they get off on Christmas Eve even if it mean extra pay for them since it’s Holiday.

Yes, you’ve heard it right. Walmart and Best Buy will be closed on Christmas Day, December 25, 2010 since it is a Holiday. Do not worry though because Walmart and Best Buy stores will return to regular business hours on the next day after Christmas which is December 26, 2010 since the Holiday is over. This will give you a chance for an early shopping come the next Holiday which is New Year’s Day on January 1, 2011.

Twas the night before christmas poem-One of the oldest and most popular Christmas poems ever, commonly referred to as "Twas The Night Before Christmas," was written in the early 19th century.

Though its author is disputed, with the poem being attributed to both Clement Clarke Moore and Henry Livingston Jr. over the years, it was definitely first published on Dec. 23, 1823 in the Troy Sentinel newspaper in upstate New York.

It is also referred to as "A Visit From St. Nicholas" or "The Night Before Christmas."

***”Make Way for Tomorrow” is the movie for people who need a good cry. Victor Moore and Beulah Bondi play an elderly couple in this heartbreaking 1937 drama from director Leo McCarey. TCM presents the movie at 10 p.m. Christmas Eve. McCarey won the best director Oscar for that year for “The Awful Truth,” a first-rate comedy. In his acceptance speech, McCarey said he won for the wrong movie; he was more proud of “Make Way for Tomorrow.” You’ll see why.

***”Remember the Night” is a movie to remember for its warmth, charm and romantic chemistry. Barbara Stanwyck and Fred MacMurray are the well-matched stars. TCM presents the 1940 comedy at midnight Friday night — yes, it’s the perfect way to start Christmas. These two performers are a long way from “Double Indemnity.” Beulah Bondi co-stars in this one; Preston Sturges wrote the delightful script.


*** Judy Garland sings “Have Yourself a Merry Little Christmas” in “Meet Me in St. Louis.” TCM offers that splendid 1944 musical at 2 a.m. Christmas Day.

***”Miracle on 34th Street” is the beloved 1947 fantasy with an Oscar-winning Santa in Edmund Gwenn. AMC presents this charmer at 8 p.m. Christmas Eve. Natalie Wood and Maureen O’Hara co-star. This, too, was a best-picture Oscar nominee for 1947. (“Gentleman’s Agreement” won for that year.)

***”White Christmas”is a splashy 1954 musical that brings together Bing Crosby, Danny Kaye, Rosemary Clooney, Vera-Ellen and the music of Irving Berlin. Michael Curtiz directed. AMC offers it at 10:15 p.m. Christmas Eve.

***”Love Actually” is a 2003 comedy-drama about Brits in love. Lifetime presents the movie at 8 p.m. Christmas Eve. The excellent cast includes Bill Nighy, Liam Neeson, Emma Thompson, Laura Linney, Colin Firth, Alan Rickman, Hugh Grant and Keira Knightley.

Walmart open on christmas 2010 -Wondering what stores are open on Christmas Day 2010? Hardly any.

Even though more stores than usual stayed open this Thanksgiving, and plenty of stores kept later hours this Christmas Eve, stores will widely be closed as typical on Christmas Day.

It's one of the few days every year in which nearly all businesses are closed across the country. Of course, this year Christmas falls on a Saturday, only solidifying the day off for many.

Walmart, Target, Kmart, Old Navy and Toys R Us were open on Christmas Eve, but will all be closed Christmas Day this year.

However, if you need to make a quick run to the store, Walgreens locations across the country will be open, and many CVS locations will also be open.

Other stores could be open locally too; it's best to check your local listings or call individual stores near you to be sure.

We'll let the Giant players and coaches take it from here. Tom Coughlin: "I've never been around anything like this in my life. It's about as empty as you get to feel in this business, right there." Kevin Boss: "I'm in disbelief . . .I'm in shock." Barry Cofield: "Disgusted and devasted." Eli Manning: "Just shock. Just unbelievable. Just kind of how did that happen?" But if the Giants win on Sunday, they clinch a playoff berth. We'll see if Manning's rousing speech on Monday did the trick. And how come every time the Giants lose a game, Bill Cowher, Michael Strahan and Tiki Barber crawl out of the woodwork?

F-E-E-T, Feet! Feet! Feet! The New York Jets' world was filled with inspirational speeches and You Tube videos this week. Mark Sanchez gave a speech to his teammates on Monday, and Rex Ryan cried again, while motivating his team on Saturday night. He didn't ask the team to win one for the Gipper, but instead to win one for his wife's feet. But the speeches worked like a charm, as the Jets won at Pittsburgh for the first time ever. The victory was impressive anyway you look at it, with all phases chipping in. Ryan and Brian Schottenheimer had strong games. Sanchez's bootleg touchdown was a gutsy call, and the players executed it to perfection. Special teams got the ball rolling, with Brad Smith's game-opening kickoff return touchdown, which was the third of his career. And the defense came through, with Jason Taylor's clutch safety and the big stop at the end, when Marquice Cole broke up the final pass of the game. It was a thrilling, nerve-wracking finish, as Dustin Keller noted, "You didn't know whether to be excited or throw up. You were somewhere in the middle." Like the Giants, a win this Sunday clinches a playoff spot for Gang Green, though they may have to do it without Sanchez. But after the week Ryan just had, does anybody even remember any of that happening?

The Dream (Week) Is Over: The New York Knicks closed out Dream Week last Friday with a loss to the Miami Heat. Only LeBron James and his new role as NBA villain can make $100-million man Amar'e Stoudemire and the Knicks look like gritty, blue-collar underdogs. There was one good thing that came from that loss: Spike Lee didn't get a chance to run around celebrating on the court like a wild man. The week took its toll on the players as they fell in overtime to the LeBron-less Cavaliers the following night. But on Wednesday, after a refreshing three days of rest and relaxation, they got back on the right track with an impressive win over Oklahoma City.

Two Out of Four Ain't Bad: Amid a whirl of Carmelo Anthony rumors, the New Jersey Nets had to play four games this week, and they fared fairly well, winning two of them. After losing to Toronto, 98-92, on Friday, they came out victorious two games in a row, defeating the Hawks on Sunday, with a big contribution from their bench, and beating the Grizzlies, 101-94, on Tuesday. They fell to New Orleans on Wednesday, though. Sasha Vujacic has been a nice shot in the arm for the team, complementing Devin Harris, Brook Lopez and Kris Humphries. They may just win more than 12 games this year after all. Unless LeBron James has them contracted before they get a chance.

Red Hot: The New York Islanders are absolutely on fire. They're 3-0-1 in their last four games. Mike Mottau is out for the season and Rick DiPietro is on injured reserve once again, but Josh Bailey is back up from the minors and he made his presence felt by scoring two goals and adding an assist in the team's decimation of the New Jersey Devils on Thursday night. John Tavares was the hero in Wednesday's overtime win over Tampa Bay. They've passed the Devils in the standings, and there's no stopping them now.

Goodbye John, Welcome Back Jacques: Lou Lamoriello just couldn't take it anymore, and fired another coach. John MacLean now joins the ranks of Bryan Trottier as local heroes who just couldn't cut it as coach for even a full season. And as Lamoriello usually does, he brought back an ex-Devil coach yet again. Welcome back, Jacques Lemaire, we hardly had a chance to miss you. Oh yeah, New Jersey lost about nine games this past week

One Malik Short: It was a quiet week for the New York Rangers. They lost on Sunday to Philadelphia, and fell short in a marathon shootout to Tampa Bay on Thursday. Derek Stepan came up with a huge third-period goal to get the game to overtime. Marian Gaborik was out with a groin injury, though, and was replaced by diminutive Norwegian Mats Zuccarello, who put the puck in the back of the net in the third round of the shootout after playing a strong game. Unfortunately, it took the Blueshirts 11 rounds to finally lose. Where's Marek Malik when you need him?

The Bionic Arm: Perpetual Pedro Feliciano moved across town and signed a two-year, $8 million deal with the New York Yankees. He set a new Met record for appearances almost every year he pitched, along with leading the league the last three seasons, and he didn't even beat up the grandfather of his children, which is rare for a New York Met reliever.

Google Colors


Holiday Gift Card Doodle by Google-Google latest doodle is their most ambitious one yet. It features a collage of artwork with the images representing the letters and colors of the Google logo. Michael Lopez, who has been “chief doodler” for the past 18 months said, “”We want to end the year with a bang.”

Google has featured some pretty fancy doodles in the past year. Some interactive, some including video, and others featuring artwork. This latest Google logo represents a combination of advanced HTML 5 web programming and stunning artwork. As you hover over each individual image, it expands so that you can see the whole thing.

For Micheal Lopez, creating this years holiday card came down to the wire. The design took five artists about 250 hours. It will be opened by hundreds of millions of people. Youre on the list.

Statue of Liberty

The Lady Liberty statue at the Benton Library dates back to the 1940's-
While many of the same statues have deteriorated or been sold for scrap metal, Benton wants to hang on to its piece of history. 

The 8 and-a-half foot tall, 300 pound replica of the statue of liberty has been a land mark of Benton for 60 years. But the community knows if they want our lady to last another half century-- restoration is a must.

"She does have some holes in her structure that are allowing water to leak inside," says library director Erin Steinsultz. 

Steinsultz says Lady Liberty was removed from her outdoor post in 2008. 
A combination of weather and vandalism put her in need of repairs from her toes up to her crown. 

"Seven rays represent the seven continents and the seven seas-- she only has three," says Steinsultz. 

In the 1940's boy scouts sold hundreds of lady liberties across the county. 
The original receipt shows it was purchased for $300.
Now only a fraction of the statues exist. 

"It's just one of those few things we have to be proud of," says Doris Heaton of the public library board.

Heaton says Benton has been featured in Statue of Liberty Club Newsletter.
Visitors have come from around the nation.

"We actually had two families stop in this summer who were traveling across the country visiting those state replicas across the country," says Steinsultz. 

Now the library wants to build a freedom plaza featuring Lady Liberty.
They are raising money for the $20-thousand project.

"We haven't reached our gaol yet but knowing the city of Benton, will reach it," says Heaton.

The statue will leave Benton in January for a yearlong restoration process. 

Poinsettia Bowl

 The Poinsettia Bowl-Less than a day after much Qualcomm Stadium was submerged under flood waters, the field is dry and the parking lot is ready to receive thousands of football fans for the Poinsettia Bowl.

Wednesday, much of the playing field was less than 2 feet of water and more than half of the huge stadium parking lot was submerged. At about 3:30 p.m., Poinsettia Bowl Exec. Director Bruce Binkowski met with city officials and stadium staff to plan how to get the venue ready for the bowl game between Navy and the SDSU Aztecs.
"We knew we had a lot of water on the stadium to get out, and a lot of great people put their heads together," Binkowski said.
An outside company brought in a giant pump which worked through the night to siphon about 1.5 million gallons of water off the playing field, Binkowski said. Meanwhile, the San Diego River receded, and crews used heavy equipment to remove mud and debris from the parking lot.

The playing field was protected by a tarp during the rainstorms. Crew uncovered it at about 4 a.m., and by mid-morning it was dry enough to paint the game logo on the turf, Binkowski said.
"The fact that it made this field playable is a tribute to all the people who work here," he said.
Officials haven't added up to cost of cleaning up from the flooding yet, but taxpayers won't be footing the bill, Binkowski promised.

Most of the parking spaces in the stadium's gigantic lot will be usable, but officials are still recommending that the 51,000 fans that have tickets for the game use public transportation to get to the stadium.
"Get to the game early. Use the trolley," Binkowski said. "All the pageantry begins at 4:30 and kickoff is at 5:06 p.m. We're going to have a great night of college football."
The Metropolitan Transit Service added trolleys for the Green Line that goes to the stadium, said Judy Leitner of the Metropolitan Transit System.

The parking lot is scheduled to open at 11 a.m. Off-site parking is available, for a fee, at San Diego State University, the Mission City Corporate Center on Northside Drive, the Marriott Mission Valley on Rio San Diego Drive, and the Town and County Hotel on Hotel Circle North.
All but the SDSU site are in Mission Valley so are potentially affected by high water.
Ticket sales will set a record for the Poinsettia Bowl, which has been played once a year while 2005. The previous largest crowd was 39,129, when Navy played Utah in 2007.

Terrelle Pryor

Ohio State Players Pryor  Suspended for Five Games
-The latest event in a 2010 college football season defined by suspensions, investigations and controversy has assured that a cloud of scandal will hang over the 2011 season.
The N.C.A.A. on Thursday suspended five Ohio State players, including quarterback Terrelle Pryor and three other starters, for five games next season for accepting improper benefits. They are, however, eligible to play in the Sugar Bowl on Jan. 4, when the Buckeyes will face Arkansas.
The violations included selling memorabilia like Big Ten championship rings and accepting discounted prices from the owner of a tattoo parlor in Columbus, Ohio.
“These are significant penalty based on findings and information provided by the university,” said Kevin Lennon, the N.C.A.A. vice president of academic and membership affairs.
While Ohio State will appeal the length of the suspensions, the news was a serious blow to one of college football’s premier programs. Pryor, who came to Ohio State as one of the most celebrated high school football recruits in recent memory, is the biggest star on campus and would have been a favourite to win the Heisman Trophy next season.
Of the other three suspended starters, tailback Dan Herron led the Buckeyes in rushing this season and DeVier Posey was the second-leading receiver. The third, left tackle Mike Adams, had a solid season after his first two years at Ohio State were marked by suspensions and underwhelming performances. The fifth player, defensive lineman Solomon Thomas, is a reserve. The players, who are all juniors, must pay between $1,000 and $2,500 to charity, depending on the amount each received for their items. (The N.C.A.A. also announced that the freshman linebacker Jordan Whiting will be suspended for a game. He has to repay $150 in discounts he received at the tattoo parlor.
Pryor owes $2,500 for selling his 2008 Big Ten championship ring; the sportsmanship award he won at the 2009 Fiesta Bowl; and his gold pants, a small charm given to Buckeyes players who beat Michigan.
“Whatever the next step of gut-wrenching is, that’s the way you feel,” Ohio State Coach Jim Tressel said of the situation.
The N.C.A.A. said that the suspensions would have been four games, but an additional game was added because the players did not immediately disclose the violations when they became aware that they were illegal.
As it is nearly every year, Ohio State was expected to be one of the top contenders for the national title next season. While Pryor would have received much of the preseason attention, Herron, Posey and Adams would all be considered potential all-Big Ten Conference performers. Faced with the prospect of sitting out nearly half of their senior seasons, the players could choose to enter April’s N.F.L. draft and use the Sugar Bowl as an audition of sorts.
“I’m not sure this would be the most advantageous time to have a job interview,” Tressel said.
If the appeals are denied, the players will miss games against Akron, Toldeo, Miami, Colorado and Michigan State. Even without the suspended players, the Buckeyes might only be underdogs against Miami, the only road game among the five, and Michigan State. The players would return for Ohio State’s Oct. 8 game at Nebraska, which will be in its first season in the Big Ten.
The ruling does not help Pryor, who is regarded by N.F.L. personnel evaluators as a project on and off the field.
“He needs to grow up, work on his consistency and grow into the leader that I think he can be,” said Dave Razzano, who worked as an N.F.L. scout for 22 years. “I wouldn’t touch him with a 10-foot pole.”

Overall Total Interceptions were 11 in 19 time Sacked with total -113 Sack Yard Lost.  Terrelle Pryor  Quarterback Rating is 196. Terrelle Pryor  made Total 120 Rushing Attempts with total 639 Rushing Yards. Yards Per Rush are 5.3. Total Rusing Touchdowns are 4 having Longest Run of 66. Total 100 Yards Rushing Game are 120.

Athletic director Gene Smith said the players were trying to help their families. The idea that a Buckeye would sell a Big Ten championship ring—as Mr. Pryor did—seems unconscionable, but, says former OSU quarterback Stanley Jackson, “I know what it’s like to grow up in poverty.”

Kevin Lennon, NCAA vice president of academic and membership affairs, said the penalties were “significant” and “based on findings and information provided by the university.”

Texaco has a Million Dollar Money Drop

Texaco has a Million Dollar Money Drop-Tonight Million Dollar Money Drop took to the tough questions and this included some seriously amazing American history. The couple looking to make good money, Steve and Jennifer took to the questions like professionals but as we watched tonight, the anxiety of putting the cash on the correct drop can be difficult. 

The fifth question of the night reminds us all why a little healthy pop culture is essential to keep the brain cells going. The question had everything to do with Texas and the products America uses. The question was 'Which of these brands was founded in the State of Texas? The three choices were quite misleading and the couple lost some cash in the process of elimination. The possible answers were Old El Paso, Alamo Rent a Car and Texaco.

The correct answer for the evening was Texaco. You might be asking yourself where was Texaco founded? According to the Internet, the Texas Fuel Company, founded in 1901 in Beaumont, Texas, by Joseph S. Cullinan, Thomas J. Donoghue, Walter Benona Sharp, and Arnold Schlaet upon discovery of oil at Spindletop. The company sold gas in all 50 states and was independent until it merged in 2001.

True grit review

 The True grit review- For the first two-thirds of their careers, the producing/directing/writing team of Ethan and Joel Coen stuck to original screenplays. (More or less: “O Brother, Where Art Thou?” claims to be based on “The Odyssey,” but isn't. “Miller's Crossing” claims not to be based on “The Glass Key,” and is.) But three of their last five features came from outside source material — someone else's screenplay (“Intolerable Cruelty”), a novel (“No Country for Old Men,” their biggest hit), and an earlier film (“The Ladykillers,” which they rebuilt pretty much from the ground up). “True Grit,” their latest, is technically a remake, but in this case they've returned faithfully to Charles Portis' wonderful novel, essentially undoing the changes wrought by Hollywood in Henry Hathaway's 1969 version.

This time around, Jeff Bridges takes on the role of Rooster Cogburn, the crotchety, drunken U.S. Marshal hired by ultra-plucky teenager Mattie Ross (Hailee Steinfeld) to capture Tom Chaney (Josh Brolin), the varmint who murdered her father. Mattie is a mere 14, but she is smart and determined way beyond her years, insisting on accompanying Cogburn as he hunts Chaney and his gang's boss, Ned Pepper (Barry Pepper). Also attaching himself to the expedition is green Texas Ranger LaBoeuf (Matt Damon).

The original "Ladykillers," with Alec Guinness and Peter Sellers, may be a classic Ealing comedy, but it didn't come freighted with the kind of baggage “True Grit” carries. The 1969 version won John Wayne his only Best Actor Oscar; it was a perfect example of a star playing off 30 years of his own image, both spoofing and honoring it.

Bridges is a certified star, but John Wayne was John Wayne; the only living actor with the iconic heft to match him in this sort of role is Clint Eastwood, who has already directed his own revisionist Western vehicles, going back at least as far as "Bronco Billy' and culminating in "Unforgiven." Bridges's star persona has a lot more to do with the Dude (from “The Big Lebowski,” his previous Coen film) than with his occasional Western roles (“Bad Company,” “Wild Bill,” “Heaven's Gate,” and, stretching the definition, “Rancho Deluxe”).

In many ways, the 1969 “True Grit” has dated; it's from the last gasp period of a certain type of Old Hollywood filmmaking. In addition to Wayne, it has the advantage of an Elmer Bernstein score, which is excellent except for its over-reliance on the bland title song, crooned by Glen Campbell (who also played LaBoeuf).

The Coens' version benefits from Roger Deakins' beautiful cinematography and a much snappier pace. (It's about 20 minutes shorter, losing a lot of utterly unnecessary meandering in the middle.) The Coens also have a better touch for comedy than Hathaway; as is their practice, they give each minor character an eccentric comic manner.

Outside of the plusses and minuses of Bridges vs. Wayne, the new cast mostly fares better. Damon is a huge improvement over Campbell, a pop star in his first big film role. Both Steinfeld and the original's Kim Darby are perfect, but, unlike Darby, Steinfeld is actually the right age. (I was going to argue that Bridges is too young, but, amazingly, he's only a year or two younger than Wayne was at the time.) The biggest surprise is that Barry Pepper is every bit as good as Robert Duvall, whose 1969 performance was great.

Most welcome of all, however, is the Coens' fidelity to the Portis book. The old version did away with the most downbeat aspect of the ending, while, strangely enough, making another element more downbeat. In nearly every story decision, Portis and the Coens trump the original.

Larry Brown Replace to Silas

Larry Brown Replace to Silas-Paul Silas has reached an agreement to take over as the Charlotte Bobcats coach for the rest of the season after Larry Brown resigned Wednesday.

Former Atlanta Hawks coach Mike Woodson also received strong consideration from Bobcats owner Michael Jordan, who listened to recommendations from Brown before deciding to hire Silas.

Former New York Knicks forward Charles Oakley, a close friend of Jordan’s, could join Silas’ staff, a league source told Yahoo! Sports.

Silas still lives in the Charlotte area and is a popular figure among the area’s pro basketball fans. He coached the Charlotte-New Orleans Hornets for 4½ seasons, reaching the playoffs four times.

Michael Jordan and Brown came to a “mutual decision,” Jordan said, to parts ways on Wednesday. The Bobcats have started the season with a disappointing 9-19 record, and Brown’s disenchantment with the job grew more obvious with every loss.

Patrick Ewing, an Orlando Magic assistant coach, was also under consideration, sources said, but Jordan worried about putting his close friend in the difficult position of being an interim coach with no assurance of a long-term deal. Utah Jazz assistant Tyrone Corbin, San Antonio Spurs assistant Mike Budenholzer, Phoenix Suns assistant Dan Majerle and Detroit Pistons assistant Darrell Walker were also potential candidates discussed internally.

Because Charlotte is inclined to make this an interim position, it would be difficult to lure a secure assistant coach without an assurance beyond this season.

The Bobcats don’t play again until Monday when they face the Pistons.

The 15th Amendment

The 15th Amendment-The federal judiciary has had a chip on its shoulder ever since Alexander Hamilton described it as the “weakest of the three departments of power.” From Marbury v. Madison and McCulloch v. Maryland  through to its present day progeny, federal judges consistently misinterpret the Constitution and misinterpret the powers assigned to them therein. In fact, for decades the district courts, courts of appeal, and the Supreme Court have gone out of their way to show that they can obliterate the Constitution just as powerfully as their sister branches.

One of the latest examples of the federal courts’ disregard for the black letter of Constitutional law is found in the Ninth Circuit Court of Appeals’ decision in the case of Gonzalez v. Arizona (2010). Handed down in October of this year, the reasoning set forth in the majority opinion written by Judge Sandra S. Ikuta is remarkably unsound, especially so in light of the concurrence of former Supreme Court Justice Sandra Day O’Connor (Justice O’Connor heard this case pursuant to the prerogative exercised pursuant to 28 U.S.C. §294(a)).

Proposition 200 was passed in November 2004 when 56% of citizens of the State of Arizona voted in favor of it. The initiative was drafted by the Protect Arizona Now (PAN) Coalition with the support of the Federation for American Immigration Reform (FAIR) and basically it requires individuals to produce proof of citizenship before they may register to vote or apply for public benefits in Arizona. The proposition also makes it a misdemeanor for public officials to fail to report persons unable to produce documentation of citizenship who apply for these benefits, and allows citizens who believe that public officials have given undocumented persons benefits to sue for remedies.

In the Ninth Circuit’s opinion, Ikuta and O’Connor held that the measure fails Constitutional muster for violating the intent of the legislature as manifest in the National Voter Registration Act of 1993 (NRVA). The decision in the case states that the “central purpose is to increase voter registration by streamlining voter registration procedures.” Therefore, as the NRVA does not require proof of citizenship as established under the provisions of Proposition 200, the state of Arizona is preempted from passing a law that illegally burdens the pre-existing federal statute.

While the court may have correctly interpreted the NRVA, it has failed to read the law in light of the powers granted to the Congress by the Constitution with regard to the regulation of elections and voting standards. Nowhere in the Constitution is Congress authorized to dictate to the states whom may be proscribed from voting. Furthermore, the plain language of Article I, Section 2 of the Constitution expressly reserves such powers to the states.

The relevant clause of Article I, Section 2 states:

The House of Representatives shall be composed of Members chosen every second Year by the People of the several States, and the Electors in each State shall have the Qualifications requisite for Electors of the most numerous Branch of the State Legislature.

Clearly, the power of qualifying electors is reserved to the states. Support for this proposition is provided by the authors of the Federalist Papers:

The first view to be taken of this part of the government relates to the qualifications of the electors and the elected. Those of the former are to be the same with those of the electors of the most numerous branch of the State legislatures. The definition of the right of suffrage is very justly regarded as a fundamental article of republican government. It was incumbent on the convention, therefore, to define and establish this right in the Constitution. To have left it open for the occasional regulation of the Congress, would have been improper for the reason just mentioned. To have submitted it to the legislative discretion of the States, would have been improper for the same reason; and for the additional reason that it would have rendered too dependent on the State governments that branch of the federal government which ought to be dependent on the people alone. To have reduced the different qualifications in the different States to one uniform rule, would probably have been as dissatisfactory to some of the States as it would have been difficult to the convention. The provision made by the convention appears, therefore, to be the best that lay within their option. It must be satisfactory to every State, because it is conformable to the standard already established, or which may be established, by the State itself.

That is to say, it is with the states and the people thereof that the right of establishing voter qualifications resides. The national legislature is specifically proscribed from establishing a nationwide “uniform rule” as such would contradict the will of the people as already expressed in the state constitutions.

Since the ratification of the Constitution in 1789 various amendments have been appended to it, many of which have addressed the issue of suffrage. The relevant amendments have restricted the right of states to deny suffrage to any citizen on account of race (15th Amendment); gender (19th Amendment); failure to pay tax (24th Amendment); or age for citizens over 18 years old (26th Amendment). Outside of these very specific federal bright line standards, states retain absolute sovereignty over the conditions they wish to set for voter qualification.

The second flank of the federal court’s attack on the states’ power to establish voter qualification standards comes from a wresting of the so-called Elections Clause. Article I, Section 4 reads in relevant part:

The Times, Places, and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

Again, a quick reference to the Federalist clarifies the already very plain text of the Constitution. In Federalist No. 60, Alexander Hamilton explained that setting voter qualifications:

forms no part of the power to be conferred upon the national government. Its authority would be expressly restricted to the regulation of the TIMES, the PLACES, and the MANNER of elections. The qualification of the persons who may choose or be chose, as has been remarked upon other occasions, are defined and fixed in the Constitution, and are unalterable by the legislature. (emphases in the original)

That is to say, the national legislature may meddle with voting only in the setting of the times, places, and manners of holding elections. Not a single syllable of our Constitution permits Congress to dictate to the qualifications they require of those seeking to vote.

Finally, the opinion handed down in the case of Gonzalez v. Arizona is another in a long, shameful line of similar rulings that misinterpret the Constitution and by so doing unlawfully encroach upon the sovereignty of the states by ignoring the principle of reserved powers. Article I and the relevant sections are disregarded so that that other sections may be unjustly expanded and so that power over the privilege of suffrage may be usurped by the national government.

The holding in this particular case purposefully changes the text of the Constitution to fit their ends. “Times, Places, and Manner” for example, is changed by the majority opinion to “mechanics of federal elections” and “regulations” and the right to “oversee the states’ procedures related to national elections.

Michelle Rex Ryan

Michelle  Rex Ryan -New York Jets coach Rex Ryan, at a news conference Wednesday, addressed the foot-fetish report posted by Deadspin.com, which showed videos of a woman who closely resembles Rex's wife, Michelle.
"To be honest, and I get it, I know you need to ask and all that stuff, but it's a personal matter and I'm really not going to discuss it, OK?" he told reporters.

He was asked about the videos throughout the conference, but continued to maintain that it was "a personal matter," according to ESPN. NFL league Spokesman Greg Aiello said the league also considers the video report a personal matter.

One video shows a woman presenting her feet and toes from an SUV window to an off-screen cameraman who touches them. Other videos show the woman sitting on a couch and rubbing her feet.

This is the latest headline-grabbing story to hit the NFL because of a Deadspin feature. Last October Minnesota Vikings' quarterback Brett Favre was involved in a "sexting" scandal when the website posted voicemails and pictures Favre allegedly sent in 2008 to former Jets game-day host and Playboy model Jennifer Sterger. Favre played for the Jets that year, and the NFL's investigation into the incident is ongoing.

During today's news conference, Ryan admitted that the video report was distracting the team from its upcoming game against the Chicago Bears to make the playoffs.

"I'll be ready to coach Chicago, and I am ready. It's my job and I'm focused on the job at hand," he said.

When asked about his wife, Ryan responded, "My wife's beautiful. We've been married for 23 years. She's awesome."

The Book of Eli

The Book of Eli itled One Thousand A.E-Last month it was revealed that Jaden Smith had been cast in director M. Night Shyamalan‘s new project, a science fiction film scripted by ournalist-turned-screenwriter Gary Whitta (The Book of Eli) titled One Thousand A.E.

At the time we didn’t know much about the project, with story details being kept tightly under wraps. The only things we were told were that it was being “developed as a vehicle for Jaden Smith” in conjunction with Overbrook Entertainment, the production company responsible for The Karate Kid, run by Will Smith, James Lassiter, Ken Stovitz, and Jada Pinkett. In addition, although there’s an adult male lead in the film, father Will is not planning to take on the part.

We now have learned a couple small new bits of information about the project.

Total Lunar Eclipse

Total Lunar Eclipse Visible-Island residents will get a full view tomorrow of the first total lunar eclipse in three years.

By 9:42 p.m. in Hawaii, the moon is expected to be entirely in the Earth's shadow, said Mike Shanahan, Bishop Museum's director of exhibits, education and planetarium.

A full moon in December follows the same high path across the sky the sun would in the summer.

"That means this one will go way overhead, over buildings and over the horizon," Shanahan said. "Folks all over the island should have a pretty good view of it."

The Bishop Museum will be hosting a viewing party from 8:30 to 11 p.m., but residents must RSVP due to limited space. Shanahan said about 500 people have already made reservations.

The eclipse begins at 7:29 p.m., just as the moon enters the outer shadow, or penumbra, of Earth. Shanahan said the moon's darkening won't begin until at least 8:32 p.m., as the moon enters Earth's inner shadow, or umbra.

From 9:42 to 10:52 p.m., the total eclipse will cast a copper or dark-red color on the moon.

"During that whole 70-minute period, that is essentially one long peak," Shanahan said.

This is the first total lunar eclipse visible to Hawaii residents since Aug. 28, 2007, and the first anywhere since December 2007, Shanahan said.

Partial lunar eclipses occur about once every six months but are not visible everywhere.

"Usually even though you have a full moon every month, the moon is a little too high or a little too low to go into the shadow of the Earth," Shanahan said. "Every six months, there will be a lunar eclipse. But if the moon is not quite fully into the shadow of the Earth, it's nowhere near dramatic as a total eclipse."

Zack Greinke

The Royal Trade Greinke-How about a little middle-of-the-night hot stove action, baseball fans?
If the reports are true, and Kansas City has dealt 2009 AL Cy Young winner Zack Greinke(notes) to Milwaukee, the Brewers should be your pick to win the NL Central.
Heck, the World Series. If you can get into the playoffs, you can win them. See: The San Francisco Giants, 2010 World Series champions.
The first report of a Greinke deal came late Saturday night from Bernie's Crew, a fan blog which is partnered with the Milwaukee Journal-Sentinel. Now, you might be thinking: Blogs. What do they know? And it's true, the Brewers beat reporter for the J-S could not confirm the deal. Yet.
But there's another report, from OnMilwaukee.com, confirming that terms have been agreed upon. Here's the trade:
For Greinke and shortstop Yuniesky Betancourt(notes), the Royals would receive outfielder Lorenzo Cain(notes) and shortstop Alcides Escobar(notes), along with minor-league pitchers Jake Odorizzi and Jeremy Jeffress(notes).
Certainly the Brewers, with one of the top offenses in the NL and a pitching staff led by two Cy Young candidates — Greinke and Yovani Gallardo(notes), along with good filler guys such as Shaun Marcum(notes) and Chris Narveson(notes) — could unseat the Reds.
Greinke slumped in 2010 but his stuff is the best the AL offers, other than that of Felix Hernandez(notes). 
The question is: Can Greinke handle the scrutiny of playing under the Milwaukee microscope? After all, going to Wisconsin is like crossing into Soviet-controlled Czechoslovakia.
I kid, of course.
Greinke famously has been treated for social anxiety disorder, which has led some to believe that he couldn't deal with pitching in, say, New York City. But with families like the Cunninghams and DeFazios on every other corner in Milwaukee County — aaaaaaayyyyyyyy! — he'd be most welcome there. 
Not that the experience wouldn't be different for Greinke; Brewers games are well-attended at Miller Park and, like I said, they'd make the playoffs with him on the pitching staff.
That second part, about the playoffs, isn't relatable to KC at all. The Royals haven't come close to winning since 1985, when they most recently won the World Series. And it's not like George Brett and Willie Wilson (right) are coming through that door for skipper Ned Yost.
The Royals, for all of their flailing at the major league level, have developed one of the top farm systems in baseball. Maybe the best.
But Greinke, who is due to make $13.5 million in each of the next two seasons before hitting free-agency, seems to have lost patience in waiting for the master plan of general manager Dayton Moore to bear fruit.
So what do the Royals get for their ace? Baseball America projected Odorizzi to be a No. 3 starter by 2013 and said Jeffress had the best fastball in KC's system. You're more likely to know Escobar — Milwaukee's starting shortstop in 2010 — and Cain, who was starting in center down the stretch.
Fangraphs listed Betancourt and Escobar as having similar value in 2010 but at 24 years old, Escobar's arrow is pointing higher. Cain's future seems bright. The Royals appear to be getting MLB-caliber players for Greinke. But is there a future All-Star in this group?
For the Brewers, this deal is reminiscent of general manager Doug Melvin going for it by adding CC Sabathia(notes) in 2008. That trade worked, in that Milwaukee made a brief appearance in the playoffs, its first since 1982.
This trade would give them at least two full seasons with Greinke. And another shot at glory.
Therefore, expect a lot more of that yanking-the-jersey-out-of-the-pants stuff after the last out for the Crew. Plus, they might bring back the Prince Fielder(notes) "explodes" thing. And hip bumps in quantity beyond anyone's wildest dreams.

Katt Williams

Katt Williams Ordered to Pay $577k

-Comedian Katt Williams has been ordered to fork over $577,929 to an Atlanta record producer -- after Katt allegedly sicked his attack dog on the other man's pet canine ... nearly killing the animal.

The producer, Merion Joseph Powers, had sued Katt in Atlanta -- claiming the comic racked up a $28k bill in his studio, but refused to pay the debt ... and when he pressed Williams for the dough, Katt paid him a visit with his attack dog in tow.

Powers alleged Katt -- in an effort to intimidate him into backing off the debt -- showed up to his studio with an attack dog and gave it a "verbal attack signal" to go after Merion's dog ... which suffered "substantial and nearly life-threatening injuries."

But when Merion had his day in court -- the judge ruled in his favor ... and ordered Katt to pay the man a whopping $577k.

The Troy University

The New Orleans Bowl

-Boo, Boo. Boo Jackson, Ohio's starting qb is a fine enough option quarterback to have helped Ohio become consistently competitive in the MAC. He also is named "Boo," features a massive head full of braids, and can (and does) take a walloping from opposing defenses with aplomb. It would be splendid to watch him in this bowl game. Sadly for Boo and his adoring public, that will not happen. Due to some kind of unspecified academic foibles both Boo Jackson and starting defensive tackle Ernie Hodge are out of the bowl game for the Bobcats.

The Trojans, Despite A Trucking Company Sponsor, Prefer Air Delivery. The Trojans are a pass-first offense, and option one is Jerrel Jernigan, quarterback Shawn Southward's preferred target and the focus of Troy's return unit on special teams, as well.They do this very, very well, and that's great because they can't stop the run at all and need to score to keep up with their iffy defense. Florida International ran for 471 yards on Troy. When the Golden Panthers can shred your ground defenses, you have a potential shootout on your hands every week (especially after a long layoff.) 

I'm still torn. Perhaps I can decide using another factor? Do with this what you will: an Ohio University football player was once charged with punching a police horse. If that kind of zest appeals to you or you've ever been bitten by an ornery mare, your decision is made.

DoT asks Telecom operators 

-Government has asked three telecom service providers - Airtel, Tata and Reliance - to put on hold their video calling services on 3G until interception facilities are cleared by security agencies.

In a letter sent to these companies, the Telecom Department (DoT) said the shortcomings in interception facilities of video calling on 3G services for the agencies need to be addressed before their launch.

The three companies were to start the video call facilities by the end of this year.

According to an exhaustive note sent by the union home ministry to the DoT, a demonstration was organised by Reliance, Tata Teleservices and Bharti during which the law enforcement agencies pointed out that online delivery of video call intercepts “in real time” could not be carried out by any of the telecom operators.

The contents of such calls were displayed only after five minutes of the completion of these calls as against the requirement of the agencies which want such details and interceptions on real-time basis, official sources said.

The DoT asked these operators to put on hold their services being offered under 3G until they address the concerns raised by the security agencies.

During the demonstration carried out by these telecom service providers, it came to light that long duration video calls, both incoming and outgoing, could not be intercepted, official sources said.

“Outgoing and incoming video calls after eight minutes could not be intercepted and displayed,” they said.

The service providers are pushing the contents of the calls in raw format to the server of the agencies, which requires use of decoders to view and listen to them, the sources said.

The security agencies pointed out that if interception is done on a 3G handset, only noise is heard as indication of video call.

“A conference call is not distinctly labelled. On the other hand, it is displayed as a two different outgoing calls,” the note said, adding the service providers should be directed to make provisions for proper tagging.

When contacted, Bharti and Reliance spokespersons said the video calls would be started by them only after complying with the security norms laid down by the government.

Tata said in a written statement that “DOCOMO demonstrated its capabilities to offer Next-Gen services like video-calls, video-SMSes and blazing high-speed data access at the time of the launch itself.

“However, in light of government’s concerns over monitoring of some services, Tata Teleservices Limited has decided to keep services like video-calling in abeyance, till such time as the requisite authorities give their approval for the same,” it said.

Eastern Washington football

Eastern Washington football-The defending Football Championship Series champion Villanova Wildcats are headed home following a 41-31 loss to Eastern Washington in a semifinal playoff game last night.

Eastern Washington will play the winner of today's Georgia Southern-Delaware game in the title game on Jan. 7 in Frisco, Texas.

Villanova star Matt Szczur left in the second half with concussion symptoms and did not return.

Through its first two playoff games, Villanova prospered in the takeaway/giveaway department. Heading west for the semifinal, the team was plus-6 in the postseason.

But on the red turf of Roos Field, the Wildcats' downfall was the fumble. They coughed up the football three times in the first half and trailed, 20-14, at intermission. A third-quarter fumble was returned 15 yards for an Eastern Washington touchdown after Villanova cut the lead to 27-24.

In all, the Wildcats turned the ball over six times.

"Obviously, I'm disappointed in the turnovers," coach Andy Talley said. "I think maybe the travel caught up to us a little bit. We'd already been to Texas and we've been all over. It's finals week for us, and our kids were taking finals [Thursday]. That's not an excuse, but it has been a rough road for us."

Four lost fumbles and an interception at the EWU 2 put the Wildcats at minus-4 in turnovers in the semifinal game alone.

Angelo Babbaro got the game off to a fast start for Villanova, returning the game's opening kick 86 yards for a touchdown while a good portion of the 6,600 in attendance were still headed to their seats.

But from there, the Wildcats put themselves in a hole.

Eastern scored on its first drive, marching 63 yards in only five plays to knot the score, 7-7.

On Villanova's first play from scrimmage, senior quarterback Chris Whitney fumbled the snap out of shotgun formation and the Eagles recovered at the Villanova 39. The Wildcats' defense stopped the nine-play drive at the 7 and Eastern converted on a 24-yard field goal to take a lead it never surrendered.

A fumble on the second Villanova possession gave the Eagles the ball back on 'Nova's 46 and, again, Eastern turned it into a field goal, this one from 31 yards out to make it 13-7.

The teams traded defensive stops, Szczur fumbled the Eastern punt and the No. 1-ranked Eagles converted the turnover into an eight-play drive, with quarterback Bo Levi Mitchell connecting with Nicholas Edwards on a 6-yard pass for the touchdown, taking a 20-7 lead with 11:14 left in the second quarter.

Whitney engineered a 70-yard, 11-play drive to make it 20-14 when Szczur scored from a yard out with 5:12 left.

Villanova cut its deficit to 20-17 on a Mark Hamilton 35-yard field goal with 7:10 left in the third quarter, but Eastern came right back with a 76-yard touchdown pass from Mitchell to Brandon Kaufman with 2:15 left in the quarter.

Once more, the Wildcats cut the Eastern lead to just a field goal. Whitney marched the team 50 yards on six plays just before the end of the third quarter, punching over from the 1 on a keeper that made it 27-24.

But a fourth fumble proved too much for the team to overcome.

This time, running back Babbaro was stopped and stripped at the Villanova 15. Tyler Washburn, Eastern's middle linebacker, took the ball out of the air and rumbled in for the touchdown with just under 14 minutes left to play.

Defensive back Jeff Minnerly picked off a Whitney pass at the Eastern 2 to thwart a Wildcats scoring threat, but the Eagles fumbled on their 14 to allow the Wildcats a second life on the drive, and Whitney punched it in again, this time from the 2, to cut the lead once again.

But on their homefield, the Eagles put the game away, running most of the final 7 minutes off the clock, capping the drive with a gutsy, fourth-down touchdown pass by Mitchell to Greg Herd in the end zone that covered 23 yards.

True freshman running back Mario Brown, filling in for injured All-America Taiwan Jones, rushed for 104 yards on 26 carries to lead the Eastern Washington offense. Mitchell completed 27 of 38 passes for 292 yards and four touchdowns.

"I think coach put it best, we didn't bring our 'A' game," Whitney said. "You can't give the ball up [six] times and expect to win a football game."

Szczur, a Senior Bowl-bound wide receiver coming off an outstanding game against Appalachian State in the quarterfinals, was limited to just four catches for 25 yards and had nine carries for 36 yards before being knocked out of the game. *
